SECTION 6
CONSTRUCTION REGULATIONS
6.1. GENERAL
In order to insure a safe, clean and orderly construction site, the ARC and the Genesee Foundation have established the following construction and safety regulations for the benefit of all Genesee owners and residents.
It is of the utmost importance that anyone conducting construction activities in Genesee use extreme care in preventing conditions that are unsafe or that could contribute to a fire or other hazard.
6.2. GENESEE WATER AND SANITATION DISTRICT REQUIREMENTS
Application for water and sewer connection permits and copies of the district specifications for service and ?meter installation should be obtained from the Water and Sanitation Office by the Contractor.
6.3. SAFETY AND HEALTH COMPLIANCE
It will be the Contractor's obligation to strictly observe all applicable State and Federal regulations and guidelines (including OSHA) at all times.
6.4. CONSTRUCTION TRAILERS AND PORTABLE FIELD OFFICES
Any owner or Contractors who desires to bring a construction trailer, field office or the like to Genesee shall obtain written approval from the ARC. The ARC will communicate with the owner or Contractor in order to determine the best location. Such temporary structures shall be placed only in the location approved by the ARC and shall be removed upon completion of construction. They are generally discouraged.
The area where the field office is located shall be considered part of the area of Construction Site disturbance and must be restored to natural contour and revegetated with Genesee seed mix, or an equivalent approved by the ARC.
6.5. LIMITS OF CONSTRUCTION SITE DISTURBANCE
It is in the best interest of the owner and the Genesee community to limit the size of the construction area and to minimize the extent of the site disturbance caused by construction activities.
6.5.1. Limits
The construction site disturbance limits as designated on the approved final documents shall be delineated on the site and maintained throughout construction with properly supported, temporary construction fencing. There shall be no disruption of natural conditions or use of any areas outside the delineated limits by construction related activities.
6.5.2. Parking
Construction crews will not park on, or otherwise use, other lots or Open Space. Private and construction vehicles and equipment will be limited to temporary parking in areas designated by the ARC.
6.5.3. Disturbance
Owners and Contractors will not disturb, damage or trespass on other lots or on Open Space. Should any damage occur, it will be restored and repaired at the offending Lot owner's expense.
6.6. STORAGE OF MATERIALS AND EQUIPMENT
Owners and Contractors are permitted to store construction materials and equipment only within the limits of the construction site disturbance. Materials shall be neatly stacked, properly covered and secured.
Any storage of materials and equipment shall be the owner's or Contractor's responsibility. The Genesee Foundation does not provide security for such storage.
6.7. DEBRIS AND TRASH REMOVAL
Owners and Contractors must maintain a trash receptacle of substantial construction and sufficient size to contain all trash and debris generated between emptying cycles. Trash receptacles shall be removed and/or emptied at a legal disposal site outside of Genesee as often as necessary. Lightweight materials and packaging shall be covered or weighted down to prevent wind from moving such items off site. Owners and Contractors are prohibited from dumping, burying or burning trash anywhere in Genesee.
In order to avoid insect infestation all trees and branches removed during the initial site grading and excavation may be temporarily stockpiled, but must be promptly removed from the lot.
During the construction period, the construction site shall be properly policed and kept clean and neat at all times. Construction shall not affect other lots or Open Space.
Dirt, mud, or debris resulting from construction activity shall be promptly removed from public and private roads, Open Space and driveways.
Clean-up costs incurred by the Genesee Foundation as a result of construction activities including trash collection and mud removal from roadways will be billed to the offending Lot owner.
6.8. SANITARY FACILITIES
Each owner and Contractor shall be responsible for providing adequate sanitary facilities for their construction workers. Portable temporary toilets shall be located within the limits of construction site disturbance.
6.9. CONSTRUCTION HOURS
All exterior construction activities that create noise disturbances, including but not limited to, excavation, foundation forming and placement, framing, roofing, siding and trim installation shall be limited to the following hours:
Monday - Friday: 7:00 a.m. to 6:00 p.m.
Saturday: 8:00 a.m. to 5:00 p.m.
Sunday: None
6.10. CONSERVATION OF LANDSCAPING MATERIALS
Owners and Contractors should be aware that many lots contain valuable native plants and other unique natural landscaping materials, such as topsoil, rock (moss rock and ordinary rock), shrubs, trees, weathered wood and rustic structures, which should be preserved to the fullest extent possible. The ARC will contact the Genesee Open Space Coordinator when the pre-design meeting is scheduled. The Open Space Coordinator will visit the site and identify unique and valuable plant materials and make recommendations regarding their preservation or relocation. Plant materials to be preserved must be protected during construction with special fencing and barriers as required by the ARC.
6.11. EXCAVATED MATERIALS
Materials excavated during construction and not re-used as an element of the landscaping portion of the approved final documents shall be removed from the Lot and disposed of legally.
6.12. BLASTING
If any blasting is to occur as a part of construction activities, the Contractor is responsible for informing the Genesee Foundation office and all residents within five hundred (500) yards of the Construction Site.
The Contractor is responsible for the safety of all people and animals, and the integrity of adjacent existing structures and natural features during blasting activities.
6.13. ROAD CLOSURES
The Contractor is responsible for notifying the Genesee Foundation office and all residents affected by the temporary closure of any road or private drive at least twenty-four (24) hours in advance of such closure.
6.14. RESTORATION AND REPAIR OF PROPERTY DAMAGE
Damage to property, including but not limited to, open space, roads, culverts, driveways, landscape improvements, existing structures or other improvements is not permitted. If such damage occurs, it will be repaired and restored promptly to the satisfaction of the ARC. Costs of the repair and restoration will be paid by the Lot owner.
Upon completion of construction, each owner and Contractor shall clean the construction site and repair improvements damaged during construction. Repair shall include, but not be limited to, damaged roads, driveways, pathways, culverts, drainage ways, signs, lighting and fencing, restoration of natural grade and reseeding of disturbed areas.
6.15. GENERAL CONSTRUCTION REQUIREMENTS
6.15.1. Conduct and Behavior
All Lot owners in Genesee shall be responsible for the proper conduct and behavior of their representatives, builders, Contractors and Subcontractors.
6.15.2. Fire Extinguisher
At least one ten-pound (1 10 lb.) capacity, ABC dry chemical fire extinguisher must be present, operational and available in a conspicuous place on the Construction Site at all times.
6.15.3. Prohibited on Site
The following practices are prohibited anywhere on the Construction Site:
a. Changing oil in any vehicle or equipment on the site itself and disposal of oil from any vehicle or equipment.
b. Cleaning concrete trucks and delivery equipment anywhere but within the limits of Construction Site disturbance. All concrete residue and waste materials shall be removed from the Construction Site prior to completion of construction.
c. Removing any rocks, plant material, topsoil, or other natural feature or stockpiled items from any property not part of the Construction Site including other Construction Sites.
d. Use of natural spring or surface water for construction.
e. Careless disposition of cigarettes and other flammable materials. Open burning is prohibited.
f. Possession of any animals or pets on a Construction Site by construction personnel.
g. Playing a radio, tape or CD player at a level that can be heard from neighboring lots.
h. Carrying any type of firearm on the property.
6.15.4 Violation Enforcement
In the event of any violation of the foregoing provisions of Paragraph 6.15.3., Items a. through h., the Genesee Foundation shall have the right to contact the Jefferson County authorities to impound the pet animal (Item f.), or to refuse to permit such Contractor or Subcontractor to continue work on the property, or to take such other action permitted by law or the Declaration.
6.16. WORK IN PROGRESS
The ARC may inspect all work in progress and, if necessary, will give notice of non-compliance. Absence of such inspection or notification during the construction period does not constitute either approval by the ARC of work in progress or compliance with these Standards or the Declaration or Supplementary Declaration.
